Dear Comptroller DiNapoli:

I hope this letter finds you well. As you may know, the Cares Act of 2020 allows government employees to withdraw funds from their deferred compensation plan, without penalty. By doing so, they can utilize these funds during these current challenging financial times.

However, it is my understanding that Tier 6 government employees do not have the same type of deferred compensation packages that other government employees have. As a result, Tier 6 employees are not able to take advantage of this program under the Cares Act.

Given this issue, I am requesting that an accommodation be made for Tier 6 employees. Tier 6 employees, like other state employees, are facing the same economic challenges. As a result, an accommodation is necessary so that they can receive some financial support.
